Política de privacidad aplicación 2D3D

 

Por medio de la descarga y uso de la aplicación 2D3D, el responsable del tratamiento Instituto de Biomecánica (IBV) garantiza al usuario la utilización de la tecnología que permitirá que de manera gratuita el usuario pueda realizarse dos fotografías de su cuerpo, incluyendo información sobre su altura, edad, género y resto de parámetros que solicite, para con ello obtener un avatar 3D que consiste en una reconstrucción 3D de su cuerpo.

Tras la descarga e instalación de la aplicación, y antes del primer uso, es necesario que el usuario conozca toda la información sobre el uso de sus datos, y tras ello, es necesario que acepte la presente política de privacidad a través de la aceptación expresa de la casilla que encontrará en la pantalla, al lado de acepto, que incluye un enlace a un sitio web de IBV en el que se recojan las condiciones.

DATOS QUE VAMOS A RECOGER

1. La información que recogemos del usuario es la siguiente: dos fotografías de cuerpo completo (de frente y perfil, en las que se ve la cara), peso, género, edad y altura.
2. La información que recogemos del dispositivo móvil: modelo y la versión de software operativo. Recogemos datos de IP (Internet Protocol) para conocer el país desde el que se está utilizando.

 

FINES DEL TRATAMIENTO

Obtención automática a partir de las 2 imágenes y los datos introducidos por el usuario de la aplicación de un avatar corporal 3D, del cual se calculan medidas antropométricas, y su conservación y uso posterior para la mejora en el servicio de reconstrucción. El usuario podrá visualizar en la aplicación su avatar y las medidas.

BASE JURÍDICA DEL TRATAMIENTO

La base jurídica del tratamiento de los datos es el contrato o relación establecida mediante la aceptación del uso de la aplicación y el consentimiento del interesado/a, en su caso, siempre revocable, y el interés legítimo para la conservación de los datos anonimizados para investigación científica del IBV.

PLAZO DE CONSERVACIÓN

El plazo de conservación será hasta que el usuario revoque su consentimiento, dirigiéndose siempre al responsable del tratamiento.
Los datos anonimizados serán conservados indefinidamente en base al interés legítimo del IBV.

DESTINATARIOS DE LOS DATOS

No está prevista la cesión de datos a terceros, en caso de divulgación de imágenes y/o datos será siempre en el ámbito del desarrollo de aplicaciones de la biomecánica con fines científicos y siempre de forma anonimizada.

DERECHOS

Tiene a su disposición el ejercicio de los derechos de acceso incluido el derecho a obtener copia de los datos personales objeto de tratamiento, rectificación, oposición, supresión o borrado en su caso, portabilidad y limitación del tratamiento, mediante un escrito ante el responsable del tratamiento a la siguiente dirección: Camino de Vera. RELACIÓN ENTRE USUARIO E IBV

El envío de los avatares al móvil funciona siguiendo los siguientes pasos: (1) la aplicación envía las dos fotos y la información del usuario al servidor IBV; (2) de manera automática se almacenan las dos fotos, se conserva la información del usuario (altura, edad, etc.), se genera el avatar y se asigna un ID único – alfanumérico y aleatorio; (3) se envía a la aplicación el ID para que visualice el avatar 3D y las medidas obtenidas; (4) la aplicación almacena la referencia del ID para poder recuperar, cuando el usuario desee, su avatar 3D. En ningún momento se guarda la información en el móvil.

Cuando realice otra petición de reconstrucción, se seguirán los mismos pasos, pero para hacer el seguimiento de las reconstrucciones en el tiempo, relaciona ID sucesivos con el primero.

El usuario dispondrá de una serie de ID que lo asocian con sus datos al servidor, de modo que cada código responde a un avatar generado por el usuario. Los códigos guardan relación con las fotografías de los usuarios, pero no guardan relación con los terminales de modo que no se podrá saber a quién corresponde cada código, ni al correo electrónico ni perfil de usuario, debiendo el usuario conservar los códigos generados por si quisiera ejercitar sus derechos, puesto que es necesario que el usuario identifique el ID concreto sobre el que desea ejercitar sus derechos, teniendo en cuenta que una vez que el usuario cambie de terminal de teléfono móvil o lo reinicie con los valores iniciales, no tendrá modo de recuperar los ID a menos que los haya anotado previamente.

ANONIMIZACIÓN DE LOS DATOS Y TRATAMIENTO PARA MEJORAR LOS ALGORITMOS

Todos los datos facilitados por el usuario serán utilizados sólo y exclusivamente para mejorar los servicios de reconstrucción mientras usted no revoque el consentimiento prestado, el IBV además conservará indefinidamente los datos anonimizados de la persona en base al interés legítimo del IBV.

Privacy policy of the 2D3D application

DATA THAT WILL BE COLLECTED

1. We collect the following information from the user: two full-length photographs (from the front and the side, which show the face), weight, gender, age and height.
2. The information we collect from the mobile device includes the model and operating software version, IP (Internet Protocol) data to know the country from which it is being used.

PURPOSE OF DATA PROCESSING

To automatically obtain, from the 2 images and the data entered by the application user, a 3D body avatar, from which the anthropometric measurements are calculated, as well as to keep them and subsequently use them to improve the reconstruction service. Users can see their avatar and the measurements in the application.

 

LEGAL BASIS OF DATA PROCESSING

The legal basis of data processing is the agreement, or the relationship established by agreeing to the use of the application and the consent of the interested party, as the case may be, which is always revocable, and the legitimate interest in keeping the anonymised data for the IBV scientific research.

RETENTION PERIOD

The retention period lasts until the user revokes consent by contacting the Data Controller. The anonymised data will be kept indefinitely based on the legitimate interest of the IBV.

RECIPIENTS OF THE DATA

Data transfer to third parties is not considered. Images and/or data may be disclosed only in the context of the development of biomechanical applications for scientific purposes and always in an anonymous way.

RIGHTS

You can exercise your rights of access, which include the right to obtain a copy of the personal data that are processed, to rectification, objection, suppression or erasure where appropriate, portability, and restriction on processing, by writing to the Data Controller to the following address Camino de Vera. RELATION BETWEEN USER AND IBV

The avatars are sent to the mobile by following these steps: (1) the application sends the two photos and the user’s information to the IBV server; (2) both images are automatically stored, the user information is saved (height, age, etc.), the avatar is generated, and a unique ID is assigned (alphanumeric and random); (3) the ID is sent to the application to visualise the 3D avatar and the measurements obtained; (4) the application stores the ID reference for the user to recover the 3D avatar. At no time is the information stored on the mobile.

When you request another reconstruction, the same steps are followed, but in order to track the reconstructions over time, the successive IDs are related to the first one.

The users will have a series of IDs that associate them, along with their data, to the server, so that each code corresponds to an avatar generated by the user. The codes are related to the photographs of the user, but they are not related to the telephones; therefore, it is not possible to know to whom each code belongs, nor the email or user profile. The users must keep the generated codes should they want to exercise their rights, since they are required to identify the specific ID on which they want to exercise their rights. It must also be taken into account that, when a mobile phone is changed or reset to the initial values, the user cannot recover the IDs unless they were previously written down.

ANONYMISATION AND DATA PROCESSING TO IMPROVE ALGORITHMS

All data provided by the user will be used exclusively to improve the reconstruction services as long as you do not revoke the consent given. Furthermore, the IBV will also indefinitely keep the anonymised data of the person based on the legitimate interest of the IBV.<
