Privacy policy for the Boxial application developed by the IBV

This document outlines the IBV privacy policy with respect to the Boxial application.

Respecting your privacy is a fundamental part of our development policy. At IBV we develop our services in accordance with the most stringent privacy principles.

IBV has developed the Boxial application, which uses a scan of the foot obtained through an iPad and a depth sensor. The information obtained from the scan is strictly necessary for 3D reconstruction.

Our privacy policy helps to explain how we handle information. We will explain, for example, what information we collect and how it affects you. We will also explain what measures we take to protect your privacy and that of those who may be affected.

“APPLICATION”, “our” or “we” refers to the application offered by IBV (Asociación Instituto de Biomecánica de Valencia – the Association of the Institute of Biomechanics of Valencia).

A licensee is a person who downloads the Application, who has registered and uses it for his or her own purposes, deciding on the content and use thereof.

Collected information

We collect personal data which is stored in accordance with the applicable legislation.

The information you provide

Your email address when you download your first scan.

IBV will not access or process the personal data of any affected people (for example, people who have their feet reconstructed in 3D) – the user who has downloaded and installed this application and who uses it for his or her own purposes is responsible for such data.

With regard to the personal data of people who submit themselves to this procedure, such personal data as the application may process once it has been downloaded will not be accessed or processed by the IBV. The application collects a scan that is stored locally, i.e., in the device of each user of this Application, as well as a series of metadata entered by the user that will be stored locally and to which the IBV has no access. The application allows the licensee to make a backup to his or her iCloud account, to which the IBV has no access.

Collected information

We do not use cookies for the operation of the application.

We do not obtain IP addresses.

We do not collect any information about the device employed to use the application.

Third-party information

We do not use any information about you that may be obtained from any third party.

What we use the information for

We use all the information we collect exclusively to ensure that the application and its support work properly, to identify the users who have used it (scanning), and to allow it to be used.

Managing the information

The information collected by the application is used for the sole purpose of ensuring that the reconstruction of the foot in 3D works properly. The information collected is only used for this purpose and is not shared with any third party.

Legislation and protection

We may collect, use, preserve and share your information if we believe in good faith that it is reasonably necessary to do so: (a) to respond appropriately to laws or regulations, legal processes or governmental requests; (b) to enforce our Terms and Conditions or any other applicable term or policy, including the investigation of any potential violation thereof; (c) to detect, investigate, prevent and address fraud and other illegal activities, or any technical or security issue; or (d) to protect the rights, property and safety of our users.

The applicable legislation for processing is Regulation (EU) 2016/679, General Data Protection.

Our global operations

You hereby accept our information practices, including the collection, use and processing of information, as described in this Privacy Policy. You hereby acknowledge that the laws, regulations and rules of the country in which your information is stored or processed may be different from those of your own country.

Your right to have your data deleted

Storage periods are determined in accordance with the applicable criteria governing time limits for complaints once you no longer use the application.

If you wish to delete your data after the storage periods, you must ask IBV to delete your data.

Updates to our policy

We may modify or update our Privacy Policy. We will update the date of the “Last Update” at the top of this Privacy Policy. By continuing to use the application, you confirm that you accept our Privacy Policy, with any modifications thereto. If you do not agree with our Privacy Policy and its modifications, you should stop using the application. Please review our Privacy Policy from time to time.

Purpose and legal basis: The purpose of the collection of data and information about the Interested Party is the download and use of the license that is covered by this Privacy Policy, to which this project refers. The legal basis for the processing of the data is the licence contract or the established relationship, the consent of the Interested Party, where appropriate, and our legitimate interest in contacting you if necessary.

Storage: The statutory time limit for actions. When consent is given, it will be until such consent is revoked or opposed, and thereafter during the period allowed for complaints to be made.

Addressees: Third party entities for research or R+D+I purposes may be addressees, provided that, in that case, they have given their consent. No data are transferred to any third parties overseas.

Rights: Access, rectification, cancellation or deletion and opposition, limitation of processing, withdrawal of consent, all of which can be exercised at the contact addresses given below.
